Pocket Gophers vs. Protected Gopher Tortoises
A pocket gopher and a gopher tortoise aren’t the same animal. Pocket gophers are rodents that create underground tunnel systems and soil mounds. Gopher tortoises and their burrows are protected under Florida law.
Florida Fish and Wildlife Conservation Commission guidance states that a relocation permit is required before relocating a gopher tortoise or disturbing a potentially occupied burrow in covered circumstances. Development activity within 25 feet of a burrow may also trigger permitting requirements. Routine yard maintenance is treated differently when it doesn’t harm a tortoise or collapse its burrow.
Don’t fill, collapse, dig into, move, or apply a control product to a suspected gopher tortoise burrow. If a tortoise or protected burrow may be present, consult the Florida Fish and Wildlife Conservation Commission or an authorized gopher tortoise agent before disturbing the area.
When Continuing Lawn Damage Needs Attention
Repeated mounds or ongoing plant damage can indicate continued underground activity. Burrowing may disturb soil, damage roots, affect garden beds, and create problems around irrigation components even when the affected surface area appears small.
